MECHANISM, two coupled moves: (1) each de-axiomatized domain passes through a NARROW gate of personalist/executive discretion, not a BROAD gate of renegotiated collective contract — so it is not returned to the demos as re-negotiable but re-closed under a new self-exempting axiom (Schmitt/Hart's self-validating fixed point), yielding a NET CONTRACTION of the contractual surface even as specific neoliberal axioms audibly fall; and (2) at the polity scale the binding-modality shifts from CONSENT-ACT to CONSENT-DEFAULT — citizens are bound to the re-versioned settlement by failure-to-exit and evacuated deliberation (present-evacuation), not by an act of assent, exactly as platform rolling-versioning binds the stranger by silence. PERMUTATION is the move that resolves an apparent paradox: the populist-nationalist moment LOOKS like de-encasement because it audibly reopens premises that were untouchable for forty years (free trade, central-bank independence). But a permutation is a re-ordering that conserves the set’s cardinality: the neoliberal axioms leave the untouchable set and a sovereigntist-security set (emergency prerogative, border necessity, ‘structural’ energy cost, national-interest-as-given) enters it — and crucially the exit is through a NARROW personalist/executive gate, not a broad democratic-contractual one (note 1835: the legislature keeps formal power while decisional content drains from the present — present-evacuation, nostalgia backward and algorithm forward both bypassing the deliberated t0). LIBERTY and EQUALITY are what is at stake in the shrinkage: the contractual surface is precisely the space where a polity can re-permute these two — trade liberty against distributive equality, security against civil liberty — by collective assent. Contract the surface and you do not settle the liberty/equality balance in any particular way; you remove the balance itself from the demos’ hands and hand it to whoever holds the self-exempting axiom. The chain is one operation at five magnifications: the CONTRACT is the negotiable register; the AXIOM is the self-exempting register that removes a domain from it; PERMUTATION is the swap of contents that disguises a constant (or rising) encasement rate as liberalization; and the casualty is the demos’ capacity to re-order LIBERTY and EQUALITY, which is exactly the capacity a shrinking contractual surface withdraws.

Philosophical basis

Five frameworks. First, the encasement / undoing-the-demos thesis (Slobodian's Globalists on the neoliberal project as constitutionally insulating markets from democratic renegotiation; Wendy Brown on the economization of the political; Streeck on the democracy-capitalism tension) — this supplies the ENCASEMENT OPERATION as a real, durable, forty-year mechanism and the prior that it persists while its objects change. Falsification criteria

Retrospectively FALSIFIED if, over the window, ANY of: (a) RE-CONTRACTUALIZATION dominates — de-axiomatized domains (trade, monetary policy, security commitments) are durably returned to broad-based deliberative renegotiation (legislative statute, ratified treaty, referendum) rather than re-closed under executive/sovereign necessity, such that the contractual surface visibly EXPANDS and the demos re-acquires re-permutation power it lacked in 2016–2024; (b) NO PERMUTATION — the neoliberal axiom-set is NOT meaningfully de-axiomatized (free trade, central-bank independence, fiscal rules persist intact) so the pattern is mere accumulation of new closures, not a swap, defeating the 'permutation/invariant-rate' core; (c) SIGNATURE FAILS — dissent from the newly-axiomatic sovereigntist-security set is routinely treated as legitimate counter-proposal within ordinary politics rather than as category-error/disloyalty, AND the 'illiteracy→disloyalty' coding-migration is not observable across the major closures; or (d) the closures are fully explained by plain executive-aggrandizement + polarization (Levitsky–Ziblatt) with no contract/axiom register doing independent work — i.e., the sign-structure is ornament. PARTIALLY CONFIRMED if the de-/re-axiomatization swap and the consent-act→consent-default shift are clearly observed but the NET-CONTRACTION-of-contractual-surface claim cannot be cleanly established (measurement under-determined).
