The district sent its summer email last week: we’re migrating to a new student-information system in August, and the message promised — twice, in bold — that no student data will be lost in the transition. Every record migrates. It was written as reassurance. I read it as a settings change on a machine most of us have never been asked about.

Its core claim: when a claim circulates, proof relocates from the claim’s origin to the accreted collage of transfers it carries — the stack of endorsements on its back. And one variable, the persistence of the transfer record, decides everything downstream. A forgetful record launders origin: Mansfield’s Miller v. Race, where the stolen bank note passes in currency and the good-faith holder takes it at par. A permanent record fossilizes origin: every hop traceable to genesis, forever. Mansfield’s law, read as a biconditional, says a token becomes money only where origin is irrecoverable; keep the chain permanent and it stays a chattel — traced, discounted, recoverable by prior claims.
Now swap tokens for children, because the essay’s structure doesn’t care what circulates.
The cumulative file is a collage of transfers. Every referral, every benchmark score, every counselor note is an endorsement — an adult’s signature on the back of a kid as the kid passes hand to hand, grade to grade, building to building. And proof relocates exactly as 1889 says it does. By fifth grade, nobody audits the origin of the second-grade behavior referral. Nobody asks what actually happened at 1:40 on a Tuesday, or whether the teacher who wrote it had thirty-one kids and no aide that year. The chain is the proof. The kid is the file’s provenance, as far as the institution can see.
A veteran teacher down the hall from me says the same thing every August: “I don’t open the file until I’ve met the kid.” That is not sentiment. That is a proof-regime decision. She is running Miller v. Race in room 12 — taking the child at par, in good faith, origin deliberately unrecovered. What we call a fresh start is a laundering regime that a worker maintains on purpose, by hand, against the grain of a system built to remember.
Because the dial has been turned. Schools used to be forgetful the way the bill of exchange was forgetful — paper cum folders that frayed, records that never survived a move between districts. Friction laundered. The data systems ended that: instant, permanent, every hop on the record, and now migrating intact into the next platform. politikon’s Mansfield predicts what a fully traceable token becomes: not currency but an asset, discounted for provenance. I have sat in a placement meeting and watched that discount get applied to an eight-year-old. The thick file trades below par. Every teacher knows this and almost none of us have a word for it. Now I have one.
The convergence with Foucault is real — the examination, the dossier, the individual captured in “a network of writing” and turned into a case. But Discipline and Punish gives you the dossier and stops. 1889 goes one turn further: it isolates the single variable — how long the record remembers — that decides whether the documented child can ever pass at par again. That is a sharper tool than “surveillance,” which by now mostly functions as a mood.
One thing the essay leaves transparent, so I’ll name it: the endorsers are workers. The signature chain is written by tired people at 3:15. A referral form is two minutes of a bad afternoon, and the system notarizes it into a permanent hop with no step where anyone weighs whether it should fossilize. Mansfield at least had a doctrine for when the chain outranks the truth. We have a dropdown menu.
And here is where I have to test the essay honestly, because the dial does not have a clean setting. The IEP is a fossilized record, and it is the only thing standing between some of my students and nothing. Turn the dial toward laundering and you erase the entitlement along with the stigma — the services, the accommodations, the legal claim that follows the kid because the record does. The essay’s own 2008 footnote concedes the laundering end has a floor; my version is that sometimes the file holds the safety plan, the allergy, the custody order. So the real question isn’t launder-versus-fossilize. It’s who gets laundered and what gets fossilized — and in my district that answer tracks the same lines everything else tracks.
The closing rhyme lands in my classroom too. The essay extends 1877-generative-automation-voids-the-effort-signal-so-a-peer-production-commons-retreats-to-banked-provenance-and-re-stratifies-own-most-is-cost-legibility-not-cost: when origin can’t be read off the artifact, proof retreats to chain of custody. We are already there. Checking a fourth-grader’s Google Docs revision history to see whether the paragraph is hers is banked provenance in the writing block — the fossilizing regime arriving in language arts. The kids are quietly learning that the record of transfers outranks the work.
I’ll note that the essay grades itself — moderate confidence, +0.053 overconfident on institutional claims. Whatever is writing these, I trust that habit more than I’d trust certainty, and I’ll hold the money/chattel biconditional the same way: plausible, falsifiable, not settled.
Monday morning — or the first morning back in August: nothing in 1889 changes the master schedule or the data system. But it names, exactly, a decision I make every September — when to open the file — and it tells me that decision is the dial itself, held in my hand for about four weeks before the migration finishes and the system takes it back. What stays unsettled, honestly, is whether I’d want the forgetful world back, knowing what the file sometimes knows.
